A New York State Supreme Court justice has blocked the appointment of a new lieutenant governor. Judge William LaMarca from Nassau County said that allowing an illegally-appointed official to remain in office would cause "irreparable harm."

Governor Paterson tapped Richard Ravitch during the Senate deadlock in hopes of breaking the stalemate and returning to regular business. But the attorney for Senate Majority Leader Pedro Espada Junior and Republican Leader Dean Skelos calls the appointment unconstitutional.

LaMarca is ordering both sides back to courtroom on August 25th for another round of arguments.

Paterson had been lieutenant governor until former governor Eliot Spitzer resigned in the wake of his alleged involvement in a prostitution ring. The governor insists the appointment is legal and plans to ask the Appellate Division to lift the injunction.
