Small Gas Company Becomes First To Sue New Yorks Dec Over Drilling

A gas drilling company is suing the town of Avon, New York for its ban on high-volume hydrofracking. LeNape Resources, a small natural gas drilling company based in Alexander, sued both the DEC and Livingston County's town of Avon last month, claiming the town's ban on drilling and storage doesn't comply with state law. The company is seeking 50-million-dollars from the town, saying that's the damage done, in the form of lost business and unused mineral rights. Avon's annual budget is 3-million-dollars. Business owner John Holko says, quote "it's my business. It's all I do, and what i've spent all the money for, and i don't have much of a choice but to take action." This is the first time the DEC has been sued directly.
