Panel Upholds Injunction Against Ny Lieutenant Governor Appointment

(Albany, NY)  --  A four-justice Appellate Division panel in Brooklyn yesterday upheld a lower court injunction keeping Governor Paterson's lieutenant governor appointee from performing any duties.  Paterson appointed businessman Richard Ravitch to the position in June in an attempt to solve the Senate deadlock caused by former renegade Democratic Senator Padro Espada.

Espada jumped the aisle with Hiram Monserrate in an attempt to give Republicans power.  Just over a month later, both men had returned to their Democratic seats.  The judges wrote that Paterson doesn't have the authority to appoint a lieutenant governor, and the case will now go to the Court of Appeals.
