Gas Drilling Bans In Dryden Middlefield To Be Heard In Nys Highest Court

New York's highest court has agreed to decide on an appeal from a drilling company and a farmer challenging municipal bans on high-volume hydro-fracking. The court of appeals, without comment, has accepted two cases where lower courts upheld bans in the towns of Middlefield in Otsego County, and Dryden, near Ithaca. The case will be heard next spring. The plaintiffs argue the town bans are preventing them from making money on their property. Statewide, New York has not decided yet whether to lift a 5 year old moratorium on fracking. State health officials are still studying its effects.
