Gas Company Sues Upstate Ny Town Because Of Drilling Ban

In a move that could have implications for municipalities across the state, a Denver-based natural-gas company will try to have a local drilling ban in the Town of Dryden thrown out in court. Anschutz Exploration Corp. plans to file a lawsuit in state Supreme Court in Tompkins County this week. Dryden has been one of a handful of municipalities across the state that have altered their zoning regulations or passed legislation to ban drilling. Their zoning laws prohibit the drilling or storage of natural gas. The DEC has said a court will have to decide if their ban is legal under state law. The gas company says they hope it will be a precedent ruling. They say they just want to go straight to the court and let the law decide.
