Sparklers Remain Illegal As Cuomo Reviews Bill In NY

If your Fourth of July plans included lighting up sparklers, be aware that they remain illegal in New York.

A bill that the New York State Legislature passed June 19 would make sparklers legal in New York is still under review by Gov. Andrew Cuomo, who vetoed a similar bill the past two years.

The governor has not decided whether to sign the bill into law, spokesman Rich Azzopardi said.

Road flares and small novelty explosives, including caps for toy guns would be legal under the bill.

The fireworks legislation was sponsored by Sen. Michael Nozzolio, R-Fayette.

Nozzolio, in a written statement, noted that each year "thousands of New Yorkers travel to neighboring states for the sole reason to purchase sparklers," and that he wants to keep that revenue in New York.

The Firemen's Association of the State of New York (FASNY) has opposed the measure.
