Now, a mid-level state court will have a chance to weight in. The Joint Landowner's Commission of New York, a Binghamton-based group of pro-fracking property owners, filed an appeal Monday with the state Appellate Division of the Supreme Court. The lawsuit was dismissed by a lower court earlier this month. The group accuses Andrew Cuomo of unnecessarily delaying a decision on whether or not to allying high-volume hydrofracking in New York. Fracking has been on hold since 2008, until a health review is complete-- but Cuomo's administration has given no indication of when that will be.
