A teachers group is suing the Buffalo Public Schools

The Buffalo Teachers Federation filed a lawsuit against the Buffalo Public Schools and superintendent following the decision to change the start time of three city schools.

One intermediate and two grade schools have shown consistent low performance. So the state grants the superintendent power to adjust policies and procedures in an effort to improve the education of students.

The union claims the start time change is financial and violates the current teachers contract.  The teacher's union challenged the move in state Supreme Court.

A judge ordered a stay in the case. Now Education Commissioner Mary Ellen Elia will decide if the new start changes fall under the superintendent's authority.
