Attorney Jason Torchinsky, who represents Senate President Joe Scarnati, says it makes no sense for a commonwealth court to take up the case when it's already being heard by U.S. Supreme Court.

Opening arguments before the high court were Tuesday this week. In that case out of Wisconsin, a panel of three federal judges ruled two to one that Wisconsin's leaders went too far in using a secretive process for redrawing the maps after the 2010 census.

In Pennsylvania, a group of voters from all 18 of the congressional districts are asking the state court to declare the 2011 congressional map unconstitutional and create new maps.
