It's 48 hours from election day, and still, Democrat Ted Kaminsky has a 780 vote lead over Republican Chris McGrath in the tight special election for the Long Island seat vacated by convicted former Senate Majority Leader Dean Skelos. Kaminsky declared victory Tuesday night, but senate Republicans were unwilling to concede the election because of absentee ballots.

Senate Deputy Majority Leader John DeFrancisco says it could be months before the winner of the 9th Senate District seat is known. No matter how the 9th District race is resolved, control of the senate will remain with Republicans for the rest of this year under senate rules, unless three fifths of the senators vote the change the rules.
